	To be an authorized affiliate of For My Kids, LLC, you agree to abide by the terms and conditions contained in this agreement. Please read this agreement carefully before registering and using the For My Kids, LLC service as an affiliate. By signing up for the For My Kids, LLC affiliate program, you indicate your acceptance of this agreement and its terms and conditions. Definitions: "Website" means www.ForMyKidsOnline.com and all associated pages. “Affiliate” means any person, entity, or agent operating a website and/or other promotional methods who drives traffic to this Website or Website content. "Visitor" means any person or entity that is not the Affiliate or the Affiliate’s agent that visits this Website only through an Internet link provided by this Website for use by an Affiliate. "Transaction" means any purchase of merchandise, excluding any shipping costs and taxes, on this Website made by a Visitor. “Payout” means any payments to Affiliates for generating a Transaction, and such payments are based on a percentage of total merchandise purchased by a Visitor. Terms of Payment: Affiliates will be notified of the initial Payout percentage and Payout terms upon activation of an Affiliate account. The Payout percentage is subject to increase based on the volume of Transactions generated by Visitors to this Website. Affiliates may not be compensated if they or their agent are the Visitor. Multiple Visitors from the same IP address over a short period of time may not be considered Transactions. Terms of Use: This Agreement authorizes the Affiliate to display a banner or other link to this Website for promotional purposes. Affiliate may not use the terms “For My Kids”, “Vinegar of the Four Thieves”, or “Four Thieves” in meta tags or as a PPC search term for Google AdWords, Yahoo Search Marketing, or any other PPC search engine. Posting links to or content from this Website in third party newsgroups, message boards, blogs, unsolicited email and other types of spam, link farms, counters, chatrooms, or guestbooks is not allowed. Links to this Website must not mislead visitors, and should not cause any transactions to be made that are not in good faith, including, but not limited to, using any device, program, robot, Iframes, or hidden frames. Affiliate may not infringe the proprietary rights (including, but not limited to, trademark rights) of this Website or any other third party linked to this Website. Affiliate will refrain from copying or modifying any icons, buttons, banners, graphics files or content contained in the banner or link to this Website including, but not limited to, refraining from removing or altering any copyright or trademark notices. Affiliate must maintain updated links to this Website to ensure Transactions. Affiliate must provide and maintain current account information. Affiliate represents and warrants that all promotional means used to direct Visitors to this Website will not contain objectionable content (including but not limited to content that is misleading, libelous, defamatory, obscene, violent, bigoted, hate-oriented, illegal, and/or promoting illegal goods, services or activities), and that will not mislead others. Any suspected fraudulent, abusive, or otherwise illegal content or activity by an Affiliate or any of its agents is grounds for immediate termination of this agreement and the Affiliate’s account. Affiliate will not engage in and/or facilitate spamming, indiscriminate advertising or unsolicited commercial email or otherwise fail to comply with the CAN SPAM Act of 2003 (Public Law 108-187 or any successor legislation), and/or any other laws and/ or regulations that govern email marketing and/or communications. Affiliate will not engage in pop-up or pop-under advertising using any means involving third party properties and/or services (software). Affiliate’s privacy policy must comply with all laws and regulations regarding the privacy of Visitor information. Affiliate is responsible for all usage and activity on the Affiliate’s account and for loss, theft or unauthorized disclosure of the Affiliate’s password (unless such disclosure is due to this Website’s negligent or willful conduct or omission). If information that is confidential and proprietary to a third party is transmitted to an Affiliate, the Affiliate agrees to maintain the confidentiality of and to protect any proprietary interests of the disclosing party. If an Affiliate breaches any terms of this Agreement, this Agreement and the Affiliate’s account may be terminated immediately. The Affiliate or the Affiliate’s agent warrants that the person executing this Agreement is authorized to do so on the Affiliate’s behalf. IF YOU ARE AN INDIVIDUAL, YOU REPRESENT AND WARRANT THAT YOU WERE AT LEAST 18 YEARS OF AGE ON THE EFFECTIVE DATE OF THIS AGREEMENT. YOU HEREBY AGREE TO INDEMNIFY, DEFEND, AND HOLD FOR MY KIDS, LLC AND ANY OF THEIR RESPECTIVE DIRECTORS, OFFICERS, SHAREHOLDERS, EMPLOYEES, AGENTS, ATTORNEYS, ADVERTISERS, AND PUBLISHERS HARMLESS FROM ANY LIABILITY, LOSS, CLAIM, OR EXPENSE, INCLUDING REASONABLE ATTORNEYS' FEES, RELATED TO YOUR VIOLATION OF THIS AGREEMENT. ANY OBLIGATION OR LIABILITY OF FOR MY KIDS, LLC UNDER THIS AGREEMENT SHALL BE LIMITED TO THE TOTAL OF YOUR PAYOUTS PAID TO YOU BY FOR MY KIDS, LLC UNDER THIS AGREEMENT DURING THE YEAR PRECEDING THE CLAIM. NO ACTION, SUIT OR PROCEEDING SHALL BE BROUGHT AGAINST THE OTHER PARTY TO THIS AGREEMENT MORE THAN ONE YEAR AFTER THE TERMINATION OF THIS AGREEMENT. Revised August 3, 2008
